Terms of Service

Last updated: 23 September 2026

Welcome to Chommie’s Choice. These Terms of Service govern your use of our website and your purchase of products from our store.

By accessing or using our website, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our website.

1. About Chommie’s Choice

Chommie’s Choice is an online retail store offering a variety of products to customers.

We reserve the right to update, change, or discontinue products, services, prices, or other aspects of our store at any time without prior notice.

2. Eligibility

By using our website or placing an order, you confirm that:

  • The information you provide is accurate and complete.

  • You are legally permitted to enter into a purchase agreement.

  • You will use our website only for lawful purposes.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, prices, specifications, and other information displayed on our website are accurate.

However, colours and product appearance may vary slightly depending on your device, screen settings, lighting, or the manufacturer's specifications.

We reserve the right to correct errors, inaccuracies, or omissions and to update product information at any time.

4. Prices

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

Prices may change without notice.

We reserve the right to correct pricing errors that may occur due to technical, typographical, or other errors.

If an order has been placed at an incorrect price due to an obvious error, we may contact you before processing the order to confirm whether you wish to proceed at the correct price.

5. Orders

When you place an order through our website, you are making an offer to purchase the selected products.

An order confirmation does not necessarily mean that your order has been accepted. We reserve the right to accept or decline an order where appropriate, including where:

  • A product is unavailable.

  • There is an error in the product information or price.

  • We suspect fraudulent or unauthorised activity.

  • We are unable to process payment.

  • An order contains inaccurate or incomplete information.

If we cancel an order after payment has been received, we will arrange an appropriate refund.

6. Payment

Payment must be successfully received before an order is processed and dispatched.

We may use third-party payment providers to securely process payments. By completing a transaction, you agree to provide accurate payment and billing information.

We do not intend to store your full payment-card details on our website.

7. Shipping and Delivery

We deliver orders according to the shipping options and delivery information displayed at checkout or communicated to you.

Estimated delivery times are not guaranteed and may be affected by circumstances outside our control, including courier delays, severe weather, public holidays, incorrect delivery information, or other unforeseen circumstances.

You are responsible for providing accurate delivery information when placing your order.

Once an order has been dispatched, tracking information may be provided where available.

8. Order Cancellation

We understand that you may occasionally need to cancel an order. Chommie’s Choice will make reasonable efforts to accommodate cancellation requests, subject to the status of your order.

8.1 Cancelling Before Processing

You may request cancellation of your order before it has been processed or dispatched by contacting us as soon as possible.

Cancellation requests should include your:

  • Order number

  • Name used when placing the order

  • Reason for cancellation, where applicable

If your cancellation request is received before the order has been processed, we will make reasonable efforts to cancel the order.

If the cancellation is approved, any payment already made will be refunded using the original payment method where reasonably possible.

8.2 Orders Already Processed or Dispatched

Once an order has been processed, packed, or dispatched, it may no longer be possible to cancel it.

If your order has already been dispatched, you may need to receive the order and follow our Return & Refund Policy, where applicable.

Additional delivery or return costs may apply depending on the circumstances and the reason for the cancellation or return.

8.3 Cancellation Due to Product Availability

If we are unable to fulfil an order because a product is unavailable, discontinued, incorrectly listed, or otherwise cannot be supplied, we may cancel the affected order or item.

If payment has already been received, we will arrange an appropriate refund.

8.4 Cancellation Due to Pricing or Product Errors

In the event that an order contains an obvious pricing, product description, stock, or technical error, we reserve the right to contact you regarding the error.

Where permitted by law, we may cancel the affected order and provide an appropriate refund if payment has already been received.

8.5 Partial Order Cancellation

If you have purchased multiple products in one order, you may request cancellation of individual items before those items have been processed or dispatched.

Where a partial cancellation is accepted, we will refund the cancelled item or items using the original payment method where reasonably possible.

Any applicable delivery charges may be recalculated where appropriate.

8.6 Refunds Following Cancellation

Where an order cancellation is approved and a refund is due, the refund will generally be processed to the original payment method.

The time required for the funds to appear in your account may depend on your bank, payment provider, or other financial institution.

Chommie’s Choice cannot control processing times imposed by third-party payment providers or financial institutions.

8.7 Orders Cancelled Due to Suspected Fraud or Unauthorised Activity

We reserve the right to cancel or place an order on hold where we reasonably suspect fraudulent, unauthorised, or unlawful activity.

Where payment has already been received, any refund will be handled in accordance with applicable law and the circumstances of the transaction.

8.8 Cancellation Requests After Dispatch

If you request cancellation after your order has been dispatched, we cannot guarantee that the cancellation can be completed.

Where cancellation is no longer possible, you may have to follow the applicable return process outlined in our Return & Refund Policy.

8.9 Consumer Rights

Nothing in this Order Cancellation section is intended to remove, restrict, or limit any rights you may have under applicable South African consumer protection legislation.

Where applicable, your statutory rights will take precedence over any conflicting provision in these Terms of Service.

8.10 Cancellation Request Procedure

To request cancellation of an order, please follow these steps:

  1. Contact Chommie’s Choice as soon as possible using the contact details provided on our website.

  2. Include the following information in your cancellation request:

    • Your full name

    • Order number

    • Email address or telephone number used when placing the order

    • The item or items you wish to cancel

    • A brief reason for the cancellation, if applicable

  3. Clearly state that you are requesting an order cancellation.

  4. We will review your request and check the current status of your order.

  5. If the order has not yet been processed or dispatched, we will make reasonable efforts to cancel it.

  6. We will notify you whether your cancellation request has been accepted or whether the order has already progressed too far to be cancelled.

  7. If the cancellation is approved and a refund is due, the refund will be processed in accordance with the Refunds Following Cancellation section of these Terms and our Return & Refund Policy.

8.11 Cancellation Request Does Not Guarantee Cancellation

Submitting a cancellation request does not automatically cancel your order.

Orders may be processed or dispatched quickly, and a cancellation request may be received after fulfilment has already begun. Customers should therefore submit cancellation requests as soon as possible after placing an order.

If an order can no longer be cancelled, you may be required to follow the applicable return procedure described in our Return & Refund Policy, subject to your rights under applicable South African law.

8.12 Cancellation Confirmation

A cancellation will only be considered confirmed once Chommie’s Choice has communicated that the cancellation has been accepted.

Customers should retain any cancellation confirmation or correspondence for their records.

9. Returns and Refunds

Returns and refunds are handled in accordance with our Return & Refund Policy and applicable South African consumer protection laws.

Nothing in these Terms of Service is intended to limit any rights you may have under applicable law.

10. Promotions and Discount Codes

From time to time, Chommie’s Choice may offer promotional codes, discounts, or special offers.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash.

  • Promotions may have expiry dates or specific conditions.

  • Only one promotional code may be used per order.

  • Promotions may not be combined with other offers.

We reserve the right to modify or cancel a promotion where permitted by law.

11. Intellectual Property

All content on the Chommie’s Choice website, including text, graphics, logos, images, designs, product descriptions, videos, and other materials, is owned by or licensed to Chommie’s Choice unless otherwise stated.

  • To attempt to gain unauthorised access to our website or systems.

  • To interfere with the operation or security of our website.

  • To collect or misuse information belonging to other customers.

  • To upload or transmit malicious software or harmful code.

  • To impersonate another person or entity.

We reserve the right to restrict or terminate access to our website where appropriate.

13. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, applications, payment providers, delivery services, or other platforms.

These third parties operate independently and may have their own terms and privacy policies.

Chommie’s Choice is not responsible for the content, availability, security, or practices of third-party services outside our control.

14. Website Availability

We aim to keep our website available and functioning properly, but we do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

We may temporarily suspend or modify the website for maintenance, updates, technical issues, or other reasons.

15. Limitation of Liability

To the extent permitted by applicable law, Chommie’s Choice will not be responsible for losses arising from circumstances outside our reasonable control.

Nothing in these Terms of Service excludes or limits any liability or consumer right that cannot legally be excluded or limited under applicable South African law.

16. Personal Information

Your personal information is handled in accordance with our Privacy Policy and applicable data-protection legislation, including the Protection of Personal Information Act (POPIA), where applicable.
